The High Court has awarded an injunction to a solicitor to prevent his former lover going public.
The High Court has awarded an injunction to a solicitor. The non-disclosure injunction prevents any details of the solicitor’s relationship with a former younger lover being made public.
5RB’s William Bennett was instructed by Daryl Ingram & Co Solicitors to lead the solicitor’s, known as AVB, case in front of Mr Justice Tugendhat.
According to the judgment the first injunction was granted in May without notice because, the judge said, had notice been given “there was a risk that the purpose of the proceedings might be defeated”.
“The information concerned the personal relationship that had existed between them, and communications to and about family members,” the ruling said.
Upon returning to the court in June (5 June) the defendant, known as TDD, was represented by Teacher Stern partner Jack Rabinowicz who instructed Cloisters’ Philip Engelman. She disputed the allegations against her and fired back complaints of her own, claiming that AVB had threatened to reveal confidential details of their relationship.
Tugendhat J adjourned the proceedings to allow the parties to agree on an order that would suit both parties. The judge rejected the first order submitted, stating that: “There was no provision in the draft order for directions, or for any time limit on the undertakings”.
The parties agreed and the court approved a further draft order, agreeing directions of any future case and a date upon which the order is to expire.
